Q1. Mr. Ole Samurai was charged with stealing one cow of Mr. John before the Resident magistrate’s court at Kajiado. In the course of the trial, the key witness, Mr. Samuel Biringi told the trial Magistrate that Mr. Ole Samurai was assisted by Mr. James Santongo in stealing the cow.
The trial Magistrate believed the evidence of Mr. Samuel Biringi. He therefore issued a warrant of arrest for Mr. James Santongo, who was jointly charged and tired with Mr. Ole Samurai, for stealing the cow.
At the end of the trial Mr. James Santongo was acquitted and set free. Mr. James Santongo intends to file a civil case for malicious prosecution and false arrest against the trial magistrate and Mr. Samuel Biringi.
Prepare a reasoned legal opinion for the consideration of Mr. James Santongo. (30 marks)
