1. Define governance and discuss in detail how the institution of governance arose. (30 marks)

2. Describe the Doctrine of Separation of Powers and critically examine the extent to which it
applies in Kenya. Does this Doctrine have any significance in contemporary society?
(20 marks)

3. It has been argued that the Doctrine of Constitutional Supremacy has not been protected by
Kenyan Courts and most of these courts have ignored or given little emphasis to this concept
enshrined in the Kenyan Constitution. Discuss this submission and provide case-law and
specific provisions in the Kenyan Constitution, to support your answer. (20 marks)

4. Distinguish (if there is any difference) between citizenship and nationality. In what may one
acquire nationality in Kenya and in what ways could he lose it? (20 marks)

5. In constitutionalism, the people are the ultimate source of authority. Discuss (20 marks)
