(1). (i) Discuss the main issues of governance that were highlighted under Agenda Item No.4 by the National Reconciliation committee under the auspices of the panel of Eminent African personalities after the post Election Vio0lence 2007/2008 in Kenya. (20 marks)
(ii) What is the significance of the National Accord and Reconciliation Act, 2008? (10 marks)
(2) Discuss the processes of amending the constitution of Kenya 2010 by way of;
(i) Popular initiative (10 marks)
(ii) Parliamentary initiative (10 marks)
(3) What were the roles played by the different organs of review under the Constitution Review of Kenya Act, 2008? (20 marks)
(4) In January 2012 the President mkarimu of the Republic of Wadosi called the leading media houses to state house to address the nation, live on Television. In his speech, he stated that he decided to suspend the country’s Chief Justice and his deputy because they had failed to carry out the much needed reforms and that he appointed Mr. Supafu SC, leading constitutional lawyer to carry out the much needed reforms in the judiciary as per the new constitution. This news never went down well with the leading political activists in the country. A number of them organized mass action condemning the President’s move.
You are a constitutional expert. ‘Refined Constitution Network’ (RNC), a non-governmental civil group
has approached you seeking advice on the way forward. The constitution of the Republic of Wadosi has
similar provisions as those in the Constitution of Kenya (2010). Advise RCN on the way forward.
