b) State and explain in detail at least FIVE sources of the Kenyan law.

c) Differentiate between legal and moral wrongs. (6marks)


d) Write short notes on the following:-
i) Substantive law (3marks)
ii) Procedural law (3marks)

a) Certain contracts made by infants are treated as void, while others are

said to be voidable. Name the contracts falling into the two categories.

b) Define a contract and state the essential elements of a valid contract.
(12marks)

QUESTION THREE
a) State and explain the different ways in which agency can be created.
(12marks)


b) State the different contents which might be found in a partnership
agreement. (8marks)

QUESTION FOUR
a) State and illustrate the essential characteristics of a contract of sale of
goods, what is the difference between a sale and an agreement to sell?

b) Describe the remedies of a buyer against the seller in the sale of goods.
(8marks)

QUESTION FIVE
a) State and explain the different remedies available for the breach of a
contract. (8marks)


b) A who is a Kenyan National and a businessman has fought with a Ugandan National. The fight has occurred or happened at the Kenya- Ugandan boarder but just a few metres towards Uganda. Advise the police who has taken up the case on the law which is applicable under the circumstances and the remedies which are available for the assaulted Ugandan National. (12marks)
