2. Answer question one and any two questions. Question one carries 30 marks and the rest 20 marks each.

1. (a) Explain the meaning of labor law [2 Marks]
(b) The Attorney General through Gazette Notice No. 3204 of May 2001 set up a Taskforce to review Kenya Labor laws. Outline the terms of reference for the Taskforce. [10 Marks]
(c) Explain five sources of Labor Law in Kenya. [10 Marks]
(d) Highlight the effect of collective agreements as contained in the Labor Relations
Act 2007. [8 Marks]
2. (a) Explain the conditions necessary for the existence of valid contract of service. [10 Marks]
(b) Explain the common Law duties to parties of contract of employment.
[10 Marks]
3. (a) In relation to the Employment Act 2007, state eight deductions an employer may
make from wages of his/her employee. [8 Marks]
(b) Outline six fundamental reasons why an employer may dismiss an employee for
gross misconduct. [12 Marks]
4. Discuss the general provisions under the Occupational Safety and Health Act 2007, which are intended to safeguard the welfare of an employee. [20 Marks]
