1 (i) Briefly outline the two schools of thought regarding the role of law in
Industrial undertaking and show the school that you support and why

(ii) Job insecurity is very high in Kenya. Under which circumstances can the
employer lawfully terminate the service of his employee? (7 marks)
(iii) Give various reasons why you think strong trade union is a useful asset to both
management and employees. (5 marks)
(iv) Point out the major blocks that hinder the progress of collective bargaining in
many of the industries in Kenya. (5 marks)
(v) Differentiate an employee from an apprentice (3 marks)
(vi) Discuss the area agricultural wage committee under wage and salary
regulation act of Kenya. (6 marks)

2. (i) Many industries in developing countries are hit by serious industrial unrest.
What are the major causes of industrial disputes? (6 marks)
(ii) Suggest effective ways of reducing industrial dispute in any undertaking
(6 marks)
(iii) Examine industrial court as one of machineries for industrial dispute setting
and identify the measures taken under trade union act to ensure that industrial
court does not overshadow other machineries stipulate for settling industrial
dispute. (8 marks)

3 (i) Discuss the main feature of factory act of Kenya (10 marks)
(ii) Explain how workers participate in industrial democracy and show how this
improves industrial relations. (5 marks)
(iii) How would you identify whether an employee is under contract of service or
contract for service? (5 marks)

4.(i) For many years employees suffered in the hands of their employers. With the
help of quotations from various labour acts show how the government of Kenya has
shown its concerned with social and economic well-being of employees.

(ii) Kamau claims that he has never received medical relief from the NHIF for the
period that he has been hospitalized. How would you justify whether Kamau
qualifies for medical relief from NHIF? (5 marks)
