Question One
Read the case below and answer the following questions.
Mr. Kimani is a branch manager of a Kenyan bank at Mombasa city. His staff included a clerk and an attendant. Very often Mr. Kimani was left along in the bank after 5pm to tally accounts day book and complete all other formatting. On 30th December, 2010 Mr. Kimani was working past 2 am to tally the accounts since hardly one day is left for closing the accounts for the year. On that fateful night, the branch manager was attacted by a band of robbers, who looted shs. 5 million after brutally wounding Mr. Kimani’s & right hand which had been to be amputated, after recovery the branch manager applied for compensation. The bank manager was of the opinion that Mr. Kimani violated, the specification by working beyond the stipulated hours of work.
