1. (i) (a) Define the following terms;
(i) Evidence [2 Marks]
(ii) Law of evidence [2 Marks]
(b) Discuss the principal characteristics of a judicial trial that distinguish the process from historical and other inquiries. [9 Marks]
(ii) (a) Discuss three different logical process of judicial reasoning. [9 Marks]
(b) State six classification of “rules of evidence” and explain their artificial
restrictions on the process of Judicial reasoning”. [8 Marks]
3. (a) By providing examples, differentiate between “a question of fact” and a “question
of law”. [5 Marks]
(b) Write short notes on the following;
(i) Facts [2 Marks]
(ii) Presumption of facts. [3 Marks]
(iii) General restriction on admissibility of evidence. [4 Marks]
(iv) Facts caused by other facts. [3 Marks]
(v) Facts forming part of the same transaction. [3 Marks]
4. The rule against Hearsay is designed to avoid accepting evidence which experience suggests is likely to be unreliable. Discuss the operations and exceptions to the above rule. [20 Marks]
5. With the aid of relevant examples discuss major types of evidence. [20 Marks]
6. Discuss the facts that need not to be proved in the Kenyan Court system by citing specific provision from Evidence Act Chapter 80. [20 Marks]
