Instructions:
Answer question 1 and any other 2 questions.
1. (a) In relation to the law of contract, explain the legal principles applicable in the
following case.
Wangari has an out standing fees balance and decides to sell her laptop. Kamau
hears about it and approaches Wangari who states that she was willing to sell the
laptop for Ksh.50,000/=. Kamau tells Wangari that he could only offer
Ksh.30,000/=. Two weeks late, Kamau raises Ksh.50,000/= and goes back to
Wangari, who tells him that she got funds from elsewhere and that she was no
longer selling the laptop. Kamau insists that he had already bought the laptop
since they had reached an agreement. Advice Kamau. (5 marks)
b) Explain advantages of Acts of parliament as a source of law. (5 marks)
c) Write self explanatory notes on the following;-

d) Outline the remedies available to an injured party contracts. (10 marks)
2. Explain the different ways in which a person may become an agent. (20 marks)

b) What is the position as to vicarious where the following relationship exists.

(ii) Employer and independent contractor (8 marks)
4. a) In relation to cheques, what is a CROSSING? (2 marks)
b) Explain the different kinds of crossing of cheques (12 marks)
c) Define a promissory note and explain how it differs from a bill and a cheque. (6 marks)
5. State and explain the defences to defamation. (12 marks)
