Question One
KARIARA HOLDINGS
Kariara holdings have had several disputes with its employees raging from poor environmental working conditions, poor remuneration and harassment by management to poor communication between employers and employees. Recently, the management wrote all employees and to the Minister for labour requesting for convention of a tripartite Collective Bargaining to be facilitated by the said Minister.
On the other hand, the employees have lodged their complaints with the Kenya Industrial Court for final settlement. The employees argue that their employer has resorted to under-hand deals as well as high handedness in dealing with their grievances hence only the industrial court may be regarded as an impartial arbitrator in this case. On its part the industrial court has declined to accept the trade dispute lodged to it by the employees citing the fact that the pre-industrial court machineries for settlement of the trade dispute have to been exhausted hence it cannot accept the dispute referred.
The employees are now in a dilemma and are pondering on the possibility of taking industrial action including on all out strike against the employer to force their case. On the other hand the employer is contemplating among others things, a lock-out and even complete closure of the business because according to them, the demands by the employees will amount to economic sabotage for their company.
