QUESTION FOUR – 20 MARKS
(a) A procuring entity was in the process of evaluating tender bids for the procurement of firewood for the organisation. While the meeting was on an elderly lady came in and requested for audience. The evaluation committee chairman hesitated but members insisted that she be heard. She revealed to the committee that she was a potential supplier and requested to be given special consideration because she was poor and had a very sick patient in hospital. During the bid evaluation she was ranked 2nd. The chairman decided that she be awarded the tender on humanitarian grounds though the price quoted was highest among other tenders.
(i) In your opinion did the committee do a wrong thing? Why or why not. (5Marks) (ii) Did the committee act professionally? Were they in any ethical dilemma? Explain. (5Marks) (iii) In case of a court case arising who would be sued and on what grounds. (5Marks) (iv) As a procurement professional, how would you have handled the above situation? (5Marks)
