A) Highlight the establishment and jurisdiction of the following:
i) Supreme court (4marks)
ii) Court of appeal (4 marks)
iii) High court (4 marks)
B) Identify the various orders or writs which the high court may issue when excising the
supervisory jurisdiction (4 marks)
C) Name the courts that have jurisdiction to hear the following cases and give reasons for
your answers
i) A divorce case involving Asha and Mohammed both who confess Islamic faith (2
marks)
ii) Election petition (2 marks)

A) Explain the difference between:
i) Public and private law (4 marks)
ii) Procedural and substantive law (4 marks)
B) The constitution provides that when a bill has been passed by the national assembly it
shall be presented to the president for assent. Explain the stages that a bill shall go
through before it comes into operation as an Act of parliament. (12marks)

QUESTION THREE
A) Citing relevant case law discuss the doctrine of equitable estoppels, outlining the
circumstances under which it arises (10 marks)
B) I) what is ratification as used in the law of agency? (2 marks)
ii) Bernard and Moses agreed to meet for a business lunch at a restaurant in town. During
lunch, Chuma one of Moses’ friends joined the two and began to participate in the
discussion. Chuma told Bernard that he was Moses’ agent to which, Moses did not
object. A week later, Chuma obtained goods on credit from Bernard, allegedly on behalf
of Moses. Chuma has since disappeared and Bernard is demanding payment from Moses.
