Section A
1) The Law may be defined – as the body of Principles recognized and applied by the state in the administration of justice. (Salmond) comment (5 marks)

b)“The High Court and all subordinate courts shall be guided by African customary Law in civil cases in which one or more of the parties is subject to it, or affected by it, so far as it is applicable and is not repugnant to justice and morality or inconsistent with any written law, and shall decide all such cases according to substantial justice without undue regard to technicalities of procedure and without any delay.” Discus Customs as a source of Law (10marks)

c) A person may be defined as an entity or being which is recognized by law having certain defined rights and obligations. Discuss with illustrations and or case Law.(15 Marks)

2) With illustrations and case law discuss various rules of making an offer

3) Mr. Odawa is the Human Resource manager with Lake Feeds Company limited. His mandate includes but not limited to drawing Employment contracts. You too have been attached to the said company as a fulfillment of your degree programme. Now Mr. Otieno has been offered a place at Lake Feeds as a clerk, and Mr. .Odawa has asked you to draw an employment contract which is comprehensive. Remember clarity as a rule (20 marks)

a) Negligence as a tort (10 marks)
b) The rule s of interpretation of written rules (10 marks)
5) The Kenyan courts relate to each other in an organized and designed hierarchy. Explain with illustrations and case law. (20 Marks)
