Instructions: Answer Questions ONE and any other TWO questions.
Q1. “It is not only the perpetrator of an offence who will be liable in criminal law…people are liable through their various degrees of participation in the commission or omission of the offence”. Discuss this statement as you clearly explain the various participators of a criminal offence. (30 marks)
Q2. Conspiracy as an inchoate offence is presently governed by both common law and statutory law. Discuss. (20 marks)
Q3. Treason as an offence is provided for under S. 40 of the penal code. While discussing the various element of the offence, how relevant is the same in a liberal democracy. (20 marks)
Q4. In the case of R vs Miller (1954) ZALLER 529 it was held that a husband ca rape his wife. While analyzing the present legal provisions of the offence in Kenya, what amendments could you propose so as to have the offence being inline as it is in act. (20 marks)
