Question One

Carol hired out her BMWX5 series to car solutions Ltd for six months. It was agreed that the car would not be used for any illegal activities. The company hired the car to Kamau a known jailbird. Last week kamau was driving from Namanga to Kitengela when he was stopped by some traffic police officer for overspeeding. On stopping the police suspected Kamau was drunk and this was confirmed by an alcohol blow test. The police ordered him out of the car but Kamau ignored the order and took off at a very high speed. The police gave a chase and in the process Kamau hit Ole Kelichi and his ten year old daughter called Naisula who were walking off the road killing them instantly. The car was damaged beyond repair and kamau sustained serious injuries. On checking the car the police found ten Rhino horns and a loaded Ak47 rifle. Some rolls of bhang and whisky sachets were also found in the jacket Kamau was wearing.

Identify and explain the category of law under which the police will take action against Kamau, note to capture its distinct features.

Identify and explain the nature of the relationship between Carol and car solutions ltd and advise Carol noting to clearly bring out the relevant law and the issue of the redress available to her and against who.

Identify the cause of action (if any) available to Mama Naisula the widow/mother of the accident victims and advise her.

Assume Naisula did not sustain fatal injuries; can she file a case for the injuries suffered personally? Give your reasons.

Assume that Carol’s car was under a hire-purchase arrangement. Advice the hire purchase company.

Question Two

Identify and explain five basic principles that govern insurance transactions. Illustrate your answer with appropriate examples.

The doctrines caveat emptor and nemo dat work hand in hand in the law of sale of goods. Explain their respective meanings noting to capture their exceptions. You must use appropriate examples to suggest your answer. (20 marks)
