Q1. a) Consumer rights are fundamental rights under our law. Discuss. (10 marks)
b) A rock radio station with an extensive teenage audience conducted a contest
which rewarded the first contestant to locate a peripatetic disc jockey. The
minors driving in separate automobiles attempted to follow the disc jockeys
automobile to the next stop. In the course of their pursuit,One of the minors
negligently forced a car off the highway, killing its sole occupant. The
surviving wife and children of the deceased has filed a suit for compensation.
Who do you think is liable and what are your reasons thereof? (10 marks)
c) Assume there are 1000 lawyers willing to handle indigent cases and that only
100 lawyers participate in a boycott. If the boycott has no perceptible impact
on the provision of legal services, would it be illegal?

d) Can the firm consider the prices charged by its competitors in setting its own
prices?

Q2. a) For many years Warner-Lambert has been advertising its mouth-wash, Listerine as
being Effective in preventing or lessening the severity of colds and sore
throats. The anti-competition Authority found such claims to be deceptive and
has ordered Warner- Lambert to include the Statement ‘ contrary to prior
advertising. Listerine will not prevent colds or sore throats or lessen their
severity’ in future advertisements for Listerine. This statement was to appear
until approximately 10 million shillings had been spent on the advertising of
Listerine. Warner- Lambert has now appealed to the High Court challenging the
Authority of the Anti- competition Authority to require such extensive
corrective advertising.
