(i) Contracts interfering with sanctity of marriage.
An agreement to separate in future or remarry is void.

(ii) Marriage brokerage contracts
Contracts to introduce persons to others of opposite sex with a view of marriage are void,but an agreement to pay money to a parent/guardian in consideration of his giving his daughter in marriage is enforceable contract under customary law of Kenya.


(iii) Contracts containing sexually immoral elements
A landlord who knowingly lets out his house for prostitution cannot recover the rent.

(iv) Contracts to break the laws of a friendly country.
Any contract to violate the bond existing between the two is void.

(v) Contracts to commit fraud or crime
Courts will not allow anyone to profit out of his crime or tort.

(vi) An agreement to transfer a position from one person to another.
This is done to secure an award or honour for money.
It is illegal because its enforcement will corrupt the administration.
