Ole Losusui asked how many cattle could be reared on that farm and Mwamburi replied, “I have not used the farm for cattle rearing but I think it could support 600 cattle.”
Ole Losusui bought the farm immediately and purchased 600 cattle to rear on it.
However, the farm is unable to accommodate the cattle.
Ole Losusui is aggrieved and indents to sue Mwamburi for misrepresentation.

The problem arises by the statement made.
Mwamburi’s statement influenced Ole Losusui to purchase the farm but the statement turns out to be untrue.
Mwamburi could not have been sued since he only gave an opinion.
The statement was a mere opinion and does not amount to misrepresentation.
