Kibaki and Charity Ngilu were the leaders of NAK while Raila had organized a walkout from KANU through the LDP. As they went into elections, Raila signed MOU with Kibaki that in the event of victory and if Kibaki becomes the president of Kenya, Kibaki would offer him the post of prime minister after changing the constitution in 100 days. NAK and LDP continued to form NARC - National Rainbow Coalition. They agreed to form a government of national unity and share power on 50/50 basis, deliver a new constitution, create 500,000 jobs p.a. and end corruption, the would create the post of PM with executive powers, economic growth.
The MOU stated in part
“The following positions in the cabinet shall be allocated to the LDP to be distributed among Hon. Stephen Kalonzo Musyoka, Hon. Raila Amolo Odinga, Hon. Prof George Saitoti and Hon. Moody, namely one position of VP, then PM, the first deputy PM and one position of senior coordinating minister.
The NARC idea was to decentralize power in Kenya by moving away from a backward and colonial constitution that concentrated power in the hands of the president, the MOU stated that a coalition organ, the summit was set up by NARC leaders, the president was to convene the summit in order to discuss the appointment of the cabinet and distribution of ministerial duties.
NARC campaigns on the platform of fighting corruption, ending tribalism in the appointment of civil servants, ending nepotism, stopping cronyism in government, ending marginalization of ethnic minorities, teaching land grabbing.
But on taking power in 2003 very few of these promises were kept. The president was reluctant to finish the new constitution up to 2011 for it would reduce his powers, corruption, continued under Goldenberg, Anglo Leasing, maize scandal, Triton Petroleum, Free education fund scandal under Prof. Ongeri, CDF misuse/misallocation/abuse etc. Corruption feeds on the capitalist system of economy and thus it is not easy to stop it. Kibaki could only be expected to “control corruption” by ensuring that information about corrupt deals do not enter the public domain. As a result of corruption, Kenya loses Kshs. 68 billion annually money that could be used to cover the country’s national budget deficit.
In the Anglo-Leasing type of scandals those were aware about the scandal include the President, the VP, Minister for Internal Security, the Minister Finance, the Minister for Justice and Constitutional affairs, the AG but people like Githongo, anti-corruption client were not aware.
