1. The Constitution of Kenya (2010)
Environmental provisions in the Constitution of Kenya (2010) are included in Chapter Four under ``Rights and Fundamental Freedoms’’ Chapter Five, under ``Environment and Natural Resources’’ and Chapter Ten under ``Judicial Authority and Legal System’’. The Fourth Schedule also includes environmental provisions under ``Distinction of functions between National and County Governments’’ and Fifth Schedule titled ‘‘Legislation to be Enacted by Parliament’’.

2. Environmental Management and Coordination Act (EMCA) of 1999
- This is an Act of Parliament to provide for the establishment of an appropriate legal and institutional framework for the management of the environment and ``for the matters connected’’ therewith and incidental thereto.’’ It was assented to in 1999 and commenced in 2000. This Act established the National Environmental Management Authority (NEMA).
