1.The Constitution of Kenya

This is the supreme law of the land. It defines the rights of citizens, articulates separation of powers into the executive, legislature and judiciary. Chapter IV of the constitution (Bill of rights) mentions education as a right. Section 43(f) section 53(b) every child has a right to free and compulsory basic education. Section 55(a) provides for the right to access to relevant education and training to the youth.

2.Written laws
These are Acts of parliament provided for in the various chapters of the laws of Kenya. The Law of Kenya comprises over 500 individual Acts of Parliament and a host of rules and regulations made under the authority of Acts of Parliament, usually referred to as subsidiary legislation. There are not less than 14 Acts of parliament that touch on education in one way or another.
