Summary

Law of Evidence II Notes
The notes basically outline circumstances that led to the repeal of s.124 of the evidence act concerning tendering of evidence.

DOCUMENTARY EVIDENCE
The term evidence is not defined in the Evidence Act. In the Nigerian case of Akintola v Solano (1986)4 S.C. 114 at 184 the Supreme, Oputa J.S.C. observed the following in relation to evidence:
If a thing is self-evident, it does not require evidence. What therefore is evidence? Simply put, it is the means by which any matter of fact the truth of which is submitted to investigating may be established or disproved. Evidence is therefore necessary to prove or disprove an issue of fact.
