Most people try and avoid being part of any legal proceeding since it is time consuming.It is always better to compromise with the litigants rather than go in for court proceeding.However, when you are forced to do so it is better to be prepared and follow certain basic rules and etiquette !
Most people try and avoid being part of any legal proceeding since it is not a very pleasant experience.However, there are times when this cannot be avoided and we are forced to be a part of legal proceedings whether we like it or not.

Some time back , I had to be a part of a civil suit filed against our family and it was definitely not a very pleasant experience.Endless hours spent in the corridors of court hall and inside the over crowded, humid court rooms, many a times with no fan and seating facilities...After all that waiting , most of the time the case getting adjourned which one realizes is an endless process, can go on for years together. Also , the fact that one can never be sure or predict the outcome of the case even if you feel that you are on the right side - all this made me realize that it is always better to compromise without getting into any litigation even if it not wholly acceptable to us.
It is also a good idea to be prepared to face such a situation when you may have to be a part of a legal proceeding by knowing a few basic ground rules and etiquette that need to be followed in a court of law.

Like I wrote earlier it is always better to compromise with the litigants rather than go in for court proceeding. However, when you are forced to do so it is

better to be prepared.

1, Make sure that you have exhausted all avenues for a compromise through well wishers or the concerned lawyers. This may save time and money in the long run not to add the frustration that one may feel at the final outcome .


2, Make absolutely sure that you have all the required legal documents with you before you decide to file a case .It is advisable that you give all the required details about the case and the circumstances to your lawyer, who will then be able to guide you as to what documents will be required.It is better to have them ready before you file a case rather than run around at a later stage.

3,Litigation are time consuming and also cost a lot of money, so make sure that you are ready to face the consequences.

4,Hire a good reputed lawyer who does not make any false promises rather than one who may promise you the earth and known to use devious ways.

5,Pay your lawyer regularly since most of them have no fixed income.Your lawyer is bound to take more interest in your case and do full justice to it when he knows that he is being compensated for his efforts.

6, Delays and postponements are a common occurence in a court of law and one needs to have loads of patience and understanding and be prepared.Some cases take very long, 6-8 years before the final stage is reached so, one should be prepared to see through the case.It will never work in your favor if you decide to give up on your case half way through.

7,You get to witness many cases as you wait for your turn, and one should take this opportunity to take an interest in other cases which gives us a lot of insight into the legal system and human nature.This is an added advantage since one can never be sure as to when such experiences come in handy.

8, Finally make sure that you preserve all the legal documents pertaining to your law suit, no matter what the judgment is - positive or negative . We may not realize the importance of certain phrases and information given by the lawyers and the judge in his concluding argument that can have some legal points that might help us in some other related case at a later date.This has happened to me after 13 years and I have thanked myself for having preserved all those old documents.

Certain etiquette to be followed while attending a court case

1,One should be careful to dress in formal or at least neat clothes. Most judges get put off by loud and indecent dressing and heady perfume.

2, Always remember to switch off your mobile phone once you enter the court premises.It is legally banned but in spite of it many people do not bother to follow the rules and it is most annoying to hear the loud ring tones of a mobile phone while a court session is in progress.

3, One has to show proper respect to the Judge and the law court by following all the rules.Even if one is not aware of this, the advocates normally advise their clients as to how they should behave and conduct themselves inside a court room.

4,One should remember not to speak loudly, laugh loudly or make gestures which might distract and draw the attention of the judge .

5,It is never a good idea to openly attack the opposite party or their advocate within the court premises since it reflects badly on you and your case.One has to deal very patiently with all adverse situations that may occur while questioning or cross examination is in progress.

6,When a judge gives some suggestions , it is advisable to discuss the merits and demerits with your lawyer before coming to any conclusion.
